1. The Provider and these Terms
The provider, developer and operator of the service (hereinafter: the Provider):
- Company name
- AIWORKS Hungary Ltd
- Registered office
- 1045 Budapest, Pozsonyi utca 6/B., Magyarország
- Company registration number
- 01-10-141223
- Tax number
- 29037034-2-41
- Contact
- Contact form, or by post to the registered office address.
These Terms set out the conditions of the contract concluded between the Provider and the user of the service (hereinafter: the User) for the use of the service and the purchase of credits. These Terms apply to all users of the service. Using the service is conditional on reading and accepting these Terms and the Privacy Policy. The language of the contract is Hungarian; the contract is concluded electronically, does not qualify as a contract put in writing, and is not filed by the Provider.
2. Definitions
- Service: booster.hu, the online, AI-driven website analysis and search engine optimization (SEO/AEO/GEO/AIO) audit tool, together with the AI assistant and the related features.
- User: the natural or legal person registering for or using the Service.
- Consumer: a consumer as defined in the Hungarian Civil Code (a natural person acting outside their trade, independent occupation or business activity).
- Business: any User who does not qualify as a Consumer.
- Credit: a pre-purchased accounting unit that can be used to access the Service.
- Account: the User's personal interface created by registration.
3. Subject and content of the service (what we contract for)
The Provider performs an automated, AI-based analysis of the website(s) specified by the User across several modules and criteria (SEO, AEO, GEO, AIO), and makes the results of this – scores, observations and recommendations – as well as an AI assistant feature and the analysis history available to the User.
Express notice. The analysis is automated and is carried out partly using a third-party artificial intelligence (AI) system. The results, scores and recommendations are informational only, do not constitute professional (legal, marketing, financial or other) advice, and do not represent any guarantee or warranty of a specific outcome – in particular of a search engine or AI ranking, visibility, traffic, revenue or business result. The operation, algorithms and presentation of search engines and AI systems are independent of the Provider and change continuously.
The Provider is entitled to develop and modify the content, features and operation of the Service, and to introduce or discontinue individual features. Certain elements of the Service operate with the involvement of external providers (e.g. AI, payment, invoicing and security providers).
4. Formation of the contract, the user account
The contract is concluded electronically upon the User's registration and their express (checkbox) acceptance of these Terms and the Privacy Policy. In the case of a credit purchase, the contract in respect of the purchased credits is concluded upon successful completion of the payment.
- The User warrants the truthfulness and accuracy of the data they provide, and must keep it up to date.
- The User is responsible for keeping their sign-in credentials (password) confidential and for all activity carried out through their account. The Provider is not liable for damage arising from the unauthorized use of the User's sign-in credentials.
- A User is entitled to use one account. In order to prevent abuse, the Provider may apply reasonable limits (e.g. a registration limit per IP address), which the User acknowledges.
- The Service is not available to persons under the age of 16.
5. Credits, fees, payment, invoicing
- The Service is credit-based: a credit is a pre-purchased accounting unit that can be used to access the Service (e.g. an analysis, a comparison, an AI question). The interface displays the credit cost of each operation before it is performed.
- Package prices are the gross prices shown in the package selector at the given time, including 27% VAT. The Provider reserves the right to change prices; a change does not affect credits already purchased.
- Payment is made electronically, with the involvement of a payment provider (e.g. PayPal). Credits are added to the Account after the payment has been successfully completed.
- The Provider issues an electronic invoice for the purchase in accordance with the applicable legislation, based on the billing details provided by the User; the User is responsible for providing correct data.
- Credits do not qualify as money or a means of payment, cannot be exchanged for money, and – in the absence of the Provider's express permission to the contrary – cannot be transferred to anyone else.
6. Withdrawal and exclusion of refunds
The purchase of credits is aimed at the supply of a digital service, the performance of which begins immediately after the purchase (the credits become usable without delay).
Under Government Decree 45/2014 (II. 26.) on contracts concluded between absent parties, a Consumer would as a general rule be able to withdraw from or terminate the contract within 14 days. However, because performance begins immediately at the Consumer's express prior request, by purchasing credits the Consumer expressly requests that the supply of the service begin immediately, and acknowledges that after the performance of the service has begun they lose their 14-day right of withdrawal/termination [Government Decree 45/2014 (II. 26.), Section 29(1)(a) and (m)].
A Business (non-consumer) User is not entitled to the above right of withdrawal/termination.
Consequently, no monetary refund is available for purchased credits – whether used or unused – and fees already paid are non-refundable. Only in the event that the Service does not work on a lasting and material basis for a reason attributable to the Provider may the Provider, at its own discretion and on equitable grounds, grant a credit rebate – this does not, however, constitute an obligation to refund money.
7. Limitation and exclusion of liability
- The Service is provided as is, with the features available at the given time. The Provider does not warrant the error-free, uninterrupted, continuous operation of the Service or its fitness for a particular purpose, and is entitled to carry out maintenance, restrictions or suspensions.
- The User uses the Service entirely at their own risk. The interpretation and use of the analysis results, and any decision based on them, is the sole responsibility of the User.
- To the fullest extent permitted by law, the Provider excludes all liability for any claim arising from possible inaccuracy, incompleteness or error in the analysis, from errors in the AI's answers or recommendations, from the interpretation of the data, from changes in search engines and AI systems, from the User's decisions, from third parties' services or omissions, and further from any data loss, lost profit, business loss, or indirect or consequential damage.
- If the Provider's liability is nevertheless established, the upper limit of the Provider's liability for damages is the amount of the fee actually paid by the User in the 3 months preceding the event giving rise to the claim.
- Force majeure: the Provider is not liable for outages or defective performance caused by unavoidable events outside its sphere of interest (e.g. malfunction, network or power failure, the failure of a third-party provider, a cyber attack, an official or legislative measure).
The above limitations do not affect or exclude liability for breach of contract caused intentionally or by gross negligence, or causing harm to human life, physical integrity or health, nor the rights to which a Consumer is entitled under mandatory legislation. In such cases the Provider's liability exists in accordance with the applicable legislation.
8. The User's obligations and prohibited conduct
The User may use the Service only lawfully and for its intended purpose. The User warrants that they only analyze websites they are entitled to analyze, and that their activity does not infringe any third party's rights or any legislation.
The User is prohibited in particular from:
- placing improper, disproportionate or excessive load on the Service or the underlying infrastructure, or disrupting its normal operation;
- automated, bulk or machine access, data collection (scraping), and any conduct aimed at circumventing the limits or protective measures of the service;
- endangering the security of the Service, unauthorized access or any attempt at it, searching for or exploiting vulnerabilities, and any act aimed at breaking into the system;
- reverse engineering the software, any activity aimed at obtaining its source code, and copying, modifying or creating derivative works from the Service or parts of it;
- reselling or renting out the Service, or providing access to it for a third party without the Provider's prior written permission;
- uploading or having analyzed content that is unlawful, harmful, misleading or infringing on others' rights, and providing other people's personal data without authorization;
- conduct that damages the good reputation of the Provider or the Service, or endangers the reliability of the system.
The User is liable for damage they cause to the Provider or to a third party. The Provider is entitled to apply measures to prevent and avert unlawful, abusive use or use that endangers the security of the system, and further to restrict, suspend or terminate the account or access concerned without prior notice, without refunding unused credits. The Provider is not obliged to disclose the specific technical implementation of its protective measures.
9. Customer service and complaint handling
The Provider's customer service continuously aims to give a substantive reply as soon as possible to enquiries received through the contact form. Given that the Provider's staff may periodically be on leave, the Provider undertakes to answer enquiries and complaints received within 30 days at the latest.
Consumer disputes. A Consumer may address their complaint to the Provider; the Provider will investigate the complaint. In the absence of a settlement, the Consumer may turn to the conciliation board competent for their place of residence or for the Provider's registered office (contact details of the boards: bekeltetes.hu), or to the territorially competent consumer protection authority (government office). For information, the contact details of the Budapest Conciliation Board are: 1016 Budapest, Krisztina krt. 99.; postal address: 1253 Budapest, PO Box 10; telephone: +36 1 488 2131.
10. Intellectual property
The Service, the underlying software and source code, the user interface, the names, trade marks, logos and all related content constitute the exclusive rights of the Provider – as the developer and rights holder of the system – and are protected by copyright and other protection. For the term of the contract, the User obtains a limited, non-exclusive, non-transferable right of use to access the Service for its intended purpose. The User may use the analysis results produced for their own website for their own purposes.
11. Term, amendment and termination of the contract
- The contract is concluded for an indefinite term. The User may terminate the contract at any time by initiating the deletion of their account; termination does not give rise to a right to a refund of purchased, unused credits.
- The Provider is entitled to amend these Terms unilaterally. The Terms in force at any given time are available on this page, with a version number and an effective date. An amendment enters into force after publication (or – in the case of a material change – after the User has been appropriately informed); continued use of the Service constitutes acceptance of the amended Terms. The rights of a Consumer under mandatory legislation apply in the case of an amendment as well.
- The Provider is entitled to discontinue the Service in whole or in part with reasonable prior notice, and further to terminate the contract with immediate effect in the event of a breach of these Terms.
12. Data protection and miscellaneous provisions
The processing of personal data is governed by the Privacy Policy, which forms an inseparable part of these Terms.
- Partial invalidity: if any provision of these Terms is invalid or unenforceable, this does not affect the validity of the remaining provisions; the invalid provision is replaced by the valid rule closest to it in purpose.
- Assignment: the Provider is entitled to transfer its rights and obligations arising from the contract to a third party; this does not curtail the User's rights.
- Communication: the parties communicate primarily by electronic means (through the contact form and the email address provided for the account).
- Applicable law: these Terms and the contract are governed by Hungarian law. In matters not regulated here, in particular Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services, Act CLV of 1997 on consumer protection, Government Decree 45/2014 (II. 26.), and the relevant provisions of European Union law apply.
- Disputes: the parties will primarily settle disputes amicably; if this is unsuccessful, the Hungarian courts have jurisdiction, with the procedure of the court having competence and venue, without prejudice to the mandatory rules applicable to a Consumer.
These Terms entered into force on 2026.08.23. (version: 1.0).
